Terms of Use

​

These Terms of Use apply to the supply of any children’s activities whether booked by you on our website or directly with a member of staff, including camps, clubs, courses, events and other activities (each an ‘Activity’) and supplied by a member of the Learn Create Play Ltd T/A Edubox company (‘Edubox’). No other terms apply, other than the descriptions of the Activity which are to be found on our website and any other terms to which reference is made in these terms of use.

By booking provision with Edubox you are acknowledging your full acceptance of these Terms and Conditions and confirming that you have not relied on any term other than those contained within these Terms and Conditions.

By using our website, you confirm your acceptance of those parts of these Terms and Conditions which are applicable to use of our website.

Bookings & Payments

Payment is requested in advance of the course of provision commencing. 

The child will only be able to attend the course once payment is made in full. 

If a child misses a lesson for any reason including illness, school trip, forgetting to attend then Edubox cannot refund or credit for the session missed.

If the child chooses that they no longer want to continue with the sessions, the remaining sessions of the current course are non-refundable. Sessions that have already taken place are non-refundable in any case.

If the school or organisation is funding the sessions provided by Edubox, the school or organisation should inform of all course dates and weeks excluding in advance of the course commencing. 

If a school is funding provision and decides to not have a session within the current course (that was not arranged in advance), due to exams, timings then Edubox cannot refund or credit the session.

In some cases we ask the school to help us recover payment from the parent if Edubox is not able to recover any outstanding payments due to Edubox.

Our terms to Schools

Edubox requests schools to provide half term's notice to Edubox if they would like to stop or pause provision with Edubox.

Schools are entitled to terminate lessons with immediate effect for good reason and that includes: a supervisor not turning up to teach on multiple occasions (continued absence for any reason), the supervisor underperforms with their teaching work, and/or guilty of gross misconduct. 

Edubox request schools to keep in correspondence with Edubox throughout our time providing our services to the school.

Supervisors & Instructors

All of our supervisors or sometimes called instructors are self employed and have responsibility for their taxes and self assessment duties.

If a supervisor misses a session, Edubox will refund or credit for the missed session.

Edubox will not pay for any loss of earnings if a supervisor disputes the consultancy agreement prior to signing. Moreover, no amendments can be made to the consultancy agreement. 

If a supervisor cannot attend a session for any reason including difficulties with the commute, illness, bad weather, unforeseen circumstances, then the supervisor should inform the school as soon as possible. The supervisor should also contact Edubox and Edubox will notify the school or organisation or parent(s) as soon as Edubox hear's of this information. 

All supervisors are thoroughly vetted through the interview process and checks are done including Rights to Work in the UK, DBS, qualifications , safe guarding and care and activity led experience.

Materials & Equipment

The supervisor or instructor may bring their own equipment, materials or supplies used to lead the provision sessions.

It should be arranged with the school or organisation in advance which parties are providing the equipment and materials.

if anything were to happen with parties' property Learn Create Play Ltd trading as Edubox is covered up to £5 million of public liability insurance.

Programme Changes

In the event that we have to cancel provision for any reason, we will offer alternative provision to you. If you notify us prior to the start date of the re-arranged session that you would prefer a refund then we will refund to the person who booked the full value of the amount paid for the provision

In the event of inclement weather, suitable indoor provision will be organised to replace the outdoor provision, at the discretion of our supervisor(s).

Child Protection

All Activity Professionals hold current child protection qualifications and a DBS check certification. If a child complains of abuse, or a member of staff believes that the child is suffering from abuse, we will act in accordance with the relevant Local Authority Designated Officer, Ofsted and the multi agency safeguarding hub.

Medical information

Any relevant medical conditions of the child must be fully disclosed in writing at the time of booking and to Edubox and the supervisor before the session begins.  If a medical condition is not disclosed in this way, then Edubox will not be responsible where the steps taken by it (or not taken) would have been different if the medical condition had been disclosed.

Edubox can only administer medication in an emergency and then only where a member of the team with an appropriate level of qualification is present at the emergency.

Health & Safety

A full risk assessment will be carried out by us in respect of each type of provision.

By agreeing to these terms of use, you provide consent for us to administer all necessary first aid to your child as required at any time.

You must ensure that your child complies with our safety procedures, including the following:​

  • Earrings must not be worn during provision (except that newly-pierced ears may be covered with appropriate tape or fitted with a plastic retainer from a reputable jeweller).

  • Clothing appropriate to the type of provision must be worn throughout the session.

We reserve the right to exclude a child from a session if the above requirements are not met in full.

Leaving an Activity

Each child must be collected by a parent or guardian unless express written consent has been given prior to commencement of the session, confirming that the child may leave alone. A member of school staff and/or the Edubox supervisor will ensure each child is safely collected by a parent or guardian.

Film/Photography

We may from time to time take photographs/video of the provision for promotional and publicity purposes. No photograph/video including your child will be published without your express consent.

Personal Belongings

We do not accept responsibility for loss or damage to your child’s personal belongings whilst attending any sessions. You are responsible for ensuring that no valuables (including devices) are brought to the sessions by your child.

Promotions

Edubox from time to time offers promotions. If you have been issued with a promotional code, this code must be redeemed and used in accordance with both the terms and conditions of that promotion and these Terms of Use.

The terms and conditions of the promotion will be available as part of the description of the provision that you are booking. Any code which is not made available in this way will not be valid and any misuse of codes may void your booking.

Please note that only one promotional code can be entered per booking, and the sibling discount cannot be used in conjunction with any other promotional code. Some promotions will have a capped discount value.

Viewing of and Participation in Online Video Sessions

If you wish to take part or join in with any online video produced by us, the following terms apply.

You participate at your own risk. Save to the extent that it may not limit or exclude its liability by law, Edubox (including Premier Education franchisees and subsidiaries) does not accept any responsibility for viewers and participants (other than the children booked on the provision).

You may only participate if you are in good enough health/physical condition to be able to do so. If you are under ‘doctors’ orders’, have an underlying health condition or have received medical advice that would normally preclude you from a physical activity such as that offered by Edubox, you should not join in.

You must also create a safe area to participate and ensure that it is suitable for the type of provision that is the subject matter of the clip, video or stream. The area must be flat, be clear of obstruction (such as tables, light fittings, rugs), be big enough and suitable for the style of activity in which you are to take part. Please ensure clothing is suitable and appropriate for the sessions. Ensure you stay hydrated throughout your participation in the activity.

Complaints

In the unlikely event that you or your child is dissatisfied with the service we provide then please in the first instance raise it with the school and also our Edubox office team. They will deal with the problem in accordance with our policies and procedures.

If the problem is not resolved to your satisfaction then please write to our customer services team at office@educationbo.co within 7 days of your child’s attendance at the session.

We take your views and complaints very seriously and will endeavour to resolve your complaint as quickly as possible. However, refunds will only be issued if we are in breach of our Terms of Use.

The information on this site is updated regularly. However, we include information provided by third parties on our site and link to third party websites and do not accept responsibility for such third party materials.

We (or third parties) own the content on our site; you should only use this content for considering our services and making a booking (and for any other specific purposes that we make clear on the site).

For more information as to the personal data that we collect from you and what we do with that personal data, please see our privacy policy which forms part of these Terms of Use.

If any term within these Terms of Use is found to be unenforceable by a competent court, then the term shall be deleted but the remaining terms shall continue in force to the full extent permitted by law.

These Terms of Use are governed by English law and subject to the exclusive jurisdiction of the Courts of England.  If you live in Scotland, you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland, you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
